Privacy Policy

This Privacy Policy describes how we collect and use personal information that you provide us. We may change this Privacy Policy from time to time. We will post the current version of the Privacy Policy on whatalesbian.com.

Scope of this Privacy Policy:

This Privacy Policy applies to all of WAL. By "WAL" we mean features and services that we make available, including through our website at whatalesbian.com (including sub-pages) and any other WAL branded or co-branded websites (including sub-domains), whether now existing or later developed. WAL is part art project, part social experiment, and part stereotype-breaker. WAL is a division of GoCocoon LLC. When we refer to "us," "we" and "our" in this Privacy Policy, we mean GoCocoon LLC.

You are bound by the Terms Agreement:

We urge you to read the Terms Agreement carefully. By accessing WAL, you are bound by the provisions of the Terms Agreement. The Terms Agreement covers all aspects of your use of WAL, including those unrelated to our use of personal information. For example, certain categories of information that you post on WAL (such as your tagline, photo, and description of yourself) are not personal information, and are publicly available to everyone.

Personal information:

Content and information you provide – When you post content or information on WAL, we ask you for your personal information, which may include, but is not limited to, your name and e-mail address. When you purchase merchandise offered through WAL, we may also request credit card or other payment account information.

Cookies – When you visit WAL, we send one or more cookies – small pieces of data that we store – to your computer or other device that uniquely identifies your browser. We use cookies or other technology to gather information about your usage of WAL to help us improve the content, usability and functionality of WAL. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent.

Log information – When you access WAL, our servers may record information that your browser sends whenever you visit a website. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser.

User communications – When you send us email or other communications, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.

Other sites – This Privacy Policy applies to WAL only. We do not control and are not responsible for other sites that may reference WAL, or hyperlink to any WAL site, or that refer to or offer any of WAL’s features, products, and services. These other sites may place their own cookies or other files on your computer, collect data or solicit personal information from you. We have no control over how these other sites collect, or what they do with, your content or information.

Content or information that you voluntarily make publicly accessible or post on WAL shall not be considered “personal information” subject to this Privacy Policy.

Our use of personal information:

When you post content or information on WAL, we ask you to provide certain personal information (such as your e-mail address). You can decline to submit any personal information to WAL, in which case we may not be able to provide certain features, products, or services to you. We will not share your personal information without your permission.

We process personal information only for the purposes for which it was collected and in accordance with this Privacy Policy or any applicable service-specific privacy notice that we may provide you. Such purposes may include:

  • contacting you;
  • providing our services, including the display of customized content and advertising, if any;
  • offering and selling our merchandise;
  • auditing, research and analysis in order to maintain, protect and improve our services;
  • ensuring the technical functioning of WAL;
  • protecting the rights or property of WAL or our users; and
  • developing new services.

Sharing personal information with others:

We only share your personal information with other companies or individuals outside of WAL in the following circumstances:

  • We have your permission.
  • We provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf.
  • We require that these parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.
  • We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable provisions of the Term Agreement, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, illegal activity, security or technical issues, or (d) protect against harm to the rights, property or safety of WAL, its users or the public as required or permitted by law.
  • If the ownership of all or substantially all of our business changes, we may transfer your information to the new owner so that the service can continue to operate. In such a case, your information would remain subject to the promises made in any pre-existing Privacy Policy.

We may share with third parties certain pieces of aggregated, non-personal information, such as the number of users on WAL. Such information does not identify you individually.

Information security and integrity:

We restrict access to personal information to our employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Please be aware that no security measures are perfect or impenetrable. We are not responsible for third parties circumventing any security measures on WAL.
